Investment Grievance
The investment grievance response mechanism (“IGRM”) is a mechanism set up within ZIDA to avoid divestment and prevent disputes between investors and the State (including Ministries, Government departments or public entities, called “MDAs”).
The investment grievance response mechanism (“IGRM”) is a mechanism set up within ZIDA to avoid divestment and prevent disputes between investors and the State (including Ministries, Government departments or public entities, called “MDAs”). It is regulated by Section 14 of Zimbabwe Investment and Development Agency (General Investments) Regulations, 2023, Statutory Instrument 227 of 2023. [link to Regulations]
The goal is to retain investment, favor expansion of existing investment projects, and avoid or mitigate disputes.
The IGRM deals with grievances of established investors (registered or not) caused by the conduct of the State (including MDAs) and/or due to external factors, actions or measures that are under the State’s immediate control. The grievance must present a risk of divestment and/or a risk of liability of the State due to a potential breach of the investor’s rights or guarantees.
Because the IGRM is a dispute and divestment prevention mechanism, it does not deal with actual disputes, unless all the parties involved agree to suspend the litigation process and ask for ZIDA’s help.
